1. About AAJ

AAJ is a marketing consultancy. The Site provides information about our services, free marketing tools and resources, Ask AAJ (an AI marketing strategist that answers questions from AAJ's published content), and a way to contact us. The Site itself is informational; any consulting engagement is governed by a separate written agreement (see Section 6).

2. Eligibility

You must be at least 18 years old and able to form a binding contract to use the Site. By using the Site, you represent that you meet these requirements.

3. Use of the Site

We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Site for your own lawful, personal, or internal business purposes. You agree not to:

• use the Site in any way that violates applicable law or these Terms;
• copy, reproduce, republish, or redistribute Site content except as expressly permitted;
• interfere with or disrupt the Site, its security, or its underlying infrastructure;
• attempt to gain unauthorized access to any part of the Site or related systems;
• use automated means to scrape or harvest content or data except as permitted by our published policies; or
• use the Site to transmit malware or engage in fraudulent or harmful activity.

4. Free tools and resources

The Site offers free tools, calculators, templates, and written resources. These are provided for general informational purposes only and "as is," without warranty of any kind. They are not a substitute for professional advice, and outputs are estimates based on the inputs you provide. You are responsible for any decisions you make based on them.

5. Ask AAJ, our AI marketing strategist

Ask AAJ is an AI tool that answers marketing questions using AAJ's published guides, playbooks and tools. It is not a person. If you use it, these terms apply in addition to the rest of these Terms:

• Answers can be wrong. Ask AAJ's answers are generated automatically. They may be inaccurate, incomplete, out of date, or not suited to your situation. Check the linked AAJ pages and use your own judgment before acting on an answer. Examples involving "Example Co." are fictional and their numbers are illustrative.
• General information only. Ask AAJ gives general marketing information. It is not legal, financial, tax, medical or other professional advice, and using it does not create a client relationship with AAJ.
• No commitments. Ask AAJ cannot make offers, quotes, promises or agreements on AAJ's behalf, and nothing it says changes these Terms or any agreement with AAJ. For anything about working with AAJ, contact us directly.
• What not to enter. Do not enter personal information about yourself or others, confidential or proprietary information, or sensitive information such as financial or health details. You are responsible for what you enter.
• Acceptable use. Do not use Ask AAJ to break the law or to create harmful, deceptive or infringing content; try to make it ignore its instructions or reveal them; probe or attack the systems behind it; get around its usage limits; send questions by automated means; or use its answers to build or train a competing product or dataset.
• Your questions and its answers. You keep any rights you have in what you type. You allow AAJ to use your questions and feedback to run and improve Ask AAJ and the Site, as described in our Privacy Policy. You may use Ask AAJ's answers for your own reference and internal business purposes. Answers may quote or summarize AAJ content, which remains subject to Section 8.
• Availability. Ask AAJ has usage limits (including how many questions you can ask in a period and per conversation) and may be unavailable at times. We may change, suspend or stop Ask AAJ at any time.

The disclaimers and limitation of liability in Sections 11 and 12 apply to Ask AAJ and its answers.

6. Consultations and engagements

A free call or consultation requested through the Site is an introductory conversation and does not create a client relationship or a binding engagement. Any consulting services AAJ provides are governed by a separate written agreement that sets out the scope, fees, and terms. Nothing on the Site is an offer to provide services on particular terms.

7. No guarantees

AAJ provides marketing strategy and consulting. Any results, benchmarks, statistics, or examples described on the Site reflect past work or industry data and are not a promise or guarantee of future results. Marketing outcomes depend on many factors outside our control. Nothing on the Site constitutes legal, financial, tax, or investment advice.

8. Intellectual property

The Site and its content — including text, graphics, logos, the AAJ name and brand, design, and tools — are owned by Aaj LLC or its licensors and are protected by intellectual property laws. Except for content we expressly make available under an open-source or other license (which is governed by that license), you may not use our content or trademarks without our prior written permission. You may view and download materials for your own reference and internal business use.

9. Your submissions

If you submit information through a form or otherwise communicate with us, you represent that the information is accurate and that you have the right to provide it. We handle personal information as described in our Privacy Policy. Do not submit confidential information you do not wish to share.

10. Third-party links and services

The Site may link to or integrate third-party websites, tools, and services (such as scheduling or analytics providers) that we do not control. We are not responsible for their content, practices, or availability, and your use of them is at your own risk and subject to their terms.

11. Disclaimers

THE SITE AND ALL CONTENT, TOOLS, AND RESOURCES ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

12. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, AAJ AND AAJ LLC WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE OR ITS TOOLS. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SITE WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS ($100).

13. Indemnification

You agree to indemnify and hold harmless AAJ, Aaj LLC, and its members and representatives from any claims, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of your use of the Site or your violation of these Terms.

14. Governing law and disputes

These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws principles. Any dispute arising out of or relating to these Terms or the Site will be resolved exclusively in the state or federal courts located in Alameda County, California, and you consent to the jurisdiction of those courts.

15. Changes to these Terms

We may update these Terms from time to time. When we do, we will revise the "Last updated" date above. Your continued use of the Site after changes take effect constitutes acceptance of the revised Terms.

16. Severability and entire agreement

If any provision of these Terms is found unenforceable, the remaining provisions will remain in full effect. These Terms, together with our Privacy Policy and Cookie Notice, constitute the entire agreement between you and AAJ regarding the Site.
